Travis County deputies unnecessarily used tasers on Tarell Brown and Tyrell Gatewood before they arrested them early Monday morning, the lawyer representing the suspended Texas players charged Tuesday.
Jamie Balagio, the attorney for Brown and Gatewood, is requesting that a videotape of the arrest be made public.
“They were both unnecessarily tasered,” Balagia told the American-Statesman Tuesday evening. “If a tape is there, let them release it to the media.”
“The only time you use a taser is to prevent you from using a gun,” Balagia said. “Basically, they said, ‘We tasered them because we didn’t want to shoot them to death.’ “
Brown, a starting cornerback, and Gatewood, a reserve safety and special teams player, were riding with former Longhorn Aaron Harris early Monday morning when Harris was pulled over by sheriff’s deputies for erratic driving. Harris passed field sobriety tests, but according to the arrest affidavit, admitted that he had been smoking marijuana. Harris had .7 grams of marijuana in his pocket and deputies found 1.1 grams of pot under the front seat of the car.
Deputies said they saw Gatewood and Brown asleep in the car — Gatewood in the front seat and Brown in the back. They said a loaded 9mm handgun was in Brown’s lap. There was no mention in the affidavit that the deputies used a taser to subdue the players.
Brown was charged with possession of a handgun, a Class A misdemeanor, and possession of marijuana, a Class B misdemeanor. Gatewood and Harris each were charged with possession of marijuana.
Roger Wade, spokesman for the sheriff’s department, said he could not comment on the case. “We don’t respond until we get to court,” Wade said.
Brown and Gatewood have been suspended from team functions and will not play Saturday against Ohio State.
The two players met with Brown on Monday afternoon after they were released from jail. They voluntarily took a urine test Monday to prove that they had not been smoking pot.
Balagia said that Gatewood had bought the gun for “recreational” purposes and had used it at an indoor shooting range about two weeks ago. Balagia said Gatewood forgot to take the gun into his apartment. Brown saw it on the floorboard in the backseat, Balagia said, and offered to take it inside once the three arrived home Monday morning. Gatewood and Brown are roommates, and Harris has been staying with them temporarily.
“When they tasered them, they made the charge against Tyrell and then jacked up the charges on Tarell,” Balagia said.

There has to be documentation of the use of a tazer. If it was in fact used, that should not only be in the narrative of the report, it should also be found in the officer's probable cause statement.

Let see, you pull over a vehicle with three large black men, and one has a 9mm in his lap. Yeah, i'd taser the sheot out of them for my protection. I'm sure there some missing information that would validate the tasering.

Oh jeez, grow up. That isn't a racist statement. Face facts, you put yourself in the shoes of the police officer, and i'm sure you'd do the same. Or would you rather form a circle, hold hands and sing kumbaiya?

I can see Brown. Why was Gatewood tasered, for sleeping? If he was just because the car had a gun, why wasn't Harris tasered?

You were talking hypothetically, in your statement, and you mentioned that they were black had something to do with it.

Why would a football player need a handgun, especially in Austin, which isn't that dangerous of a town. I should know, I spent 4 years there. These three thugs were up to no good, and you know it.

Gotta agree with Boozin on this one. A policeman walks up to a car and sees three men (who cares what color they are) and one has a gun in his lap. If they were sleeping and did not respond to the officers commands, then using a taser was justified. At that point, does the officer even know if the guys were actually asleep or acting like they were asleep. With a gun in plain view at 3am, he did what he needed to do to make sure that his safety was a priority.

Maybe if I see the video I will change my mind, but until then, I'll side with the police. As I said in my post on the other thread, this attorney for the players is a sleezy bastard. He always represents t.u. football players when they get in trouble and tries to get the media in Austin to turn on the police.

This is gonna sound racist, but it's not, so don't pull out the racial card, i'm just trying to point out the obvious.

How many times do you see three white guys being pulled over with a 9mm in their lap, with pot in the car, and the cops have to taser them?

In reading the article, it appears that more than one officer was present. That being the case, then one can cover the trio with his sidearm and another can produce a taser, thus giving a less than lethal option to the officers. The wild card in the whole situation was the pistol in Gatewood's lap. That was an immediate problem and of course the officers are going to make damn sure they go home that night. What do you expect?

Use of force must be documented. I'll guarantee one thing, if the officers had screwed up, the Sheriff would have been out front telling us that an internal investigation is ongoing.

I heard a very interesting update to this story on the news this morning. Apparently, the lawyers that are representing the two players are big t.u. fans and are only charing the players $1 to represent them. I know that lawyers are allowed to do pro bono work, but if they are only doing this b/c these are sip football players, how would this not be a big NCAA violation???? I seriously doubt that any of us would have a lawyer offer to defend us for $1 if we were in the same situation.

File a complaint with the NCAA. Lately Austin cops have been shooting first around here. I think they killed like 4 or 5 people in the last 8 months. So thats why I said the tu football players were lucky the cops didn't shoot first.

An old friend of mine who grew up in Georgetown told me the difference between Travis county(Austin), and the ajoining county Williamson(Round Rock/Georgetown).

Travis county, you get pulled over and they find a bag of weed, they dump it out and send you on your way.

Williamson county, you get pulled over and they find a roach, you go too Huntsville.

All we have is a comment from a lawyer that is trying to get his client off/lighter sentence that the police used a taser (a trigger word if you will to obtain a negitive reaction by the public.) Nothing in the report we know of, about the use of a taser and yes if it was used I am sure it would have been in the report. My big question is if you put yourself in your buds car and find a pistol under the seat would the normal and resonable person hold the gun in their lap and go to sleep? I value my limbs to much to take the chance shooting myself. Let the friend take his pistol inside himself when he gets home. I will be the good friend and remind him, not hold it for him. My guess is they wernt asleep at all and as others have said were up to no good..Just my guess.

If you find a gun in your buddies car, along with the pot, you do the smart thing. Get out, call a friend, parent or taxi and go home.
