Did anybody hear about this? Apparently, Dale Earnhardt Sr. got new life insurance prior to his death a few years ago. They started to get billed for it (actually making 2 payments), and then he was killed.
The insurance company responded that they would not be paying his life insurance because he failed to take a requested physical. In other words, this man (who has to take a physical for his job) can't be insured because we're not sure if he's in good shape or not. The argument is flimsy, but it's in court now.
The Earnhardt family and lawyers are accusing the insurance company of doing a poor investigation and unfairly and wrongly deciding to not pay so as to avoid the large payoff. Their intention isn't to follow "company policy" but instead to not lose money.
The company argues that it is policy that a contract/insurance agreement isn't valid until a physical is performed. Here's a link to some court article about public records.
