Austin teacher arrested for having sex with a student

Okay, I completely understand that it is illegal for an adult to have sex with a minor and I understand why a teacher should be fired for having sex with a student. However, I do NOT understand why it is ILLEGAL for an adult to have sex with another legal adult if that person is a student of the teacher. Did anyone else know that this was illegal?

A 34 year old male teacher was arrested this week for having consentual sex with one of his 18 year old students. Sure, the guy should be fired, but arrested? They were both adults. Why is this against the law?

On a side note, more than 20 times in 5 days. Damn. The guys should be a sex ed teacher, not a government teacher.

Yeah the teacher should be fired because of the teacher/student code, but to be arrested - NO. The story reads that the student went to his apartment and had consensual sex so this does not warrant an arrest. Now if they were doing it on campus/in a classroom, then maybe an arrest. But if the girl is 18, and going to his house, then he does not deserve to be arrested.

I didn't even know this was a crime. I know of two of my high school teachers who should've been arrested....hell one of them ended up marrying a girl I graduated with & they were dating when she was his student.

Damn, its not just illegal, its a 2nd degree felony!! Also, it reads that the student does not even have to be in the teacher's class, just enrolled in the same school that he/she teaches at. However, if the teacher and student are married, it is legal!

§ 21.12. IMPROPER RELATIONSHIP BETWEEN EDUCATOR AND STUDENT.
(a) An employee of a public or private primary or secondary school commits an offense if the employee engages in sexual contact, sexual intercourse, or deviate sexual intercourse with a person who is enrolled in a public or private primary or secondary school at which the employee works and who is not the
employee's spouse.

(b) An offense under this section is a felony of the second degree.

I think it makes sense (maybe not the felony level, though). The government makes you send your kid to school (though I guess not at that age), so the government has to make sure that their employees aren't boning kids during state run education. Basically, the state has an interest in horny teachers not undermining their system, regardless of the age of the students.

I wonder if schools mention that that's a felony. I woulda assumed that 18 = ok legally.
