As most of ya'll know I had knee surgery and missed alot of USMC drills and work . So I have been making up drills that I missed and working light duty at work. Anyways I go in to work with only about 6 hours of sleep in 3 days from making up a drill. I didn't get hom from San Antonio until 3:30 AM and got ready for work a 6 AM. I drive in to work almost fall alsleep at the wheel 2 times. Anyways I get to work and I just to tired to be here, so I ask to go home and rest. Well my new boss gives me this look like I'm stupid to even ask me this and yells just do what ever you got to do and walks off. He acts like me's pissed and maybe tommorow he might try to fire me. Whats the laws in Texas about workers who serve in the Military? Can this guy fire me because I ask off to go home and get some rest after doing 3 days of Marine drills? I have never had this problem with my old boss but he left not to long after I got hurt and they brought in this new guy and he's a total ass. Any thoughts would be helpful.

Yes your boss can fire you for wanting to go home. Basically you can be fired for any reason except those protected by discrimination laws (sex, religion, race, etc.).

Military service dosn't fall under that law?

He may be able to fire you for going home, but does your line of work really want to risk being seen as unfriendly towards the military at this particular time? :huh:

Under OSHA law I'm a safety hazzard to work and our company rule is if you have been up more than 24 hours you have to go home for 6 hrs. Also the reason I'm tired is because my drill didn't offically end till 3:30AM this morning, so technically I had drill today and buy him not letting me off seems like it would fall under Military Discrimination.

If he does fire me tomorrow I won't just go away, without getting a lawyer and getting the Marine Corps involved as well. Also I will sue their Workers Comp Insurance carrier for my on the job injury as well.

I called my CO and told him the deal with my boss, so he's personally going to put in a call to the Manager which is my bosses boss and have a little chat with him. :popcorn:
